China's Jinko Solar EU Patent Infringement Lawsuit Focuses on Longi BC Technology Patent for the Second Time and is Countersued
JinkoSolar has filed a second patent infringement lawsuit against Longi Green Energy at the Munich Local Division of the Unified Patent Court (UPC). This lawsuit alleges that Longi's high-end back contact (BC) module products infringe the European patent EP3297043, originally owned by LG, which relates to solar cell structure technology based on "selective doping passivation layers." JinkoSolar acquired the relevant rights through a strategic acquisition of LG's photovoltaic patent assets. The case focuses on Longi's Hi-MO 7, Hi-MO 9, and X10 BC module product lines, marking a shift in JinkoSolar's litigation strategy from earlier disputes over Tunnel Oxide Passivated Contact (TOPCon) technology to the increasingly competitive BC segment.

This marks JinkoSolar's second lawsuit against Longi in Germany this year. Previously, on February 14, JinkoSolar filed its first lawsuit at the UPC concerning the TOPCon-related patent EP4372829B1. Although Longi has not yet publicly responded to the BC patent allegations, it has taken countermeasures: on July 21, it applied to the UPC to invalidate the TOPCon patent involved in the February lawsuit. Meanwhile, information suggests Longi may initiate a countersuit in China using patents acquired from Mitsubishi Electric.

Notably, the patent battle between the two parties has evolved into a cross-jurisdictional confrontation. Beyond the European front, JinkoSolar sued Longi in January this year at the Nanchang Intermediate People's Court in China for infringement involving specific TOPCon technology. Additionally, in early December, JinkoSolar filed a lawsuit against Japan's Fujisolar subsidiary VSUN in the U.S. District Court for the Northern District of California, though it did not disclose specific details of the patents involved.
