The Minnesota Court of Appeals upheld the Public Utilities Commission (PUC) 2024 ruling, retroactively switching compensation rates for all community solar subscribers from the applicable retail rate to the Value of Solar (VOS) rate. This resulted in a strict reduction of 20% to 30% in compensation rates. This decision affects over 700 legacy community projects, which account for more than 60% of the state's community solar capacity. Subscribers may break even or face increased monthly electricity expenses, according to data from the Minnesota House Research Department.

Subscriber compensation shifted from bill credits based on the retail rate (which includes energy, capacity, transmission, and other costs) to the VOS rate model. The latter only compensates for the solar energy's added value to the grid. Under these constraints, community solar developers like Cooperative Energy Futures anticipate losing over 50% of member subscribers, with some households losing over $500 in annual savings. In cities like Minneapolis, 65 out of 80 subscriptions will shift from savings to costs, potentially increasing property taxes. Cities such as Saint Paul stand to lose millions of dollars over their 25-year contracts.

In industry feedback, the Minnesota Solar Energy Industries Association (MnSEIA) called the ruling "a severe blow to Minnesotans." The Community Solar Access Coalition (CCSA) emphasized that subscriber credits no longer increase with rising retail rates. Geographically focused on Minnesota, the mechanism took effect this spring. Xcel Energy was accused of attempting to stifle competition to maintain its monopoly, while opponents argue utilities should share infrastructure costs.
